With that, respecting the difficulties facing rural workers in their day by day, the benefit of Age Retirement brought privileges to this kind of worker, effectively ensuring their protection and of their families by the state. Despite the privileges granted, the rural worker must complete a series of requirements to receive the social security benefit of Age Retirement, how, for example, demonstrate the effective exercise of their activity in the field. This procedure is justified because the rural sector is one of the reasons for the Social Security deficit. It must be said that the social security legislation in force indicates how to demonstrate the rural activity. From the moment the rural worker, framed in a species of compulsory insured, specifically as special insured, prove the exercise of the activity rural area, will have right to receive the benefit. Futher, about the benefit postulation in the Judiciary, there are a great deal of controversy regarding the necessity or not of the preliminary administrative request. Before the dispute, be in the administrative or judicial sphere, in the event of doubt about which rights of worker will be applied, should always be observed, in the Social Security Law, the principle of in dubio pro misero, similar to the in dubio pro operario of the Labour Law.
